What should a tutoring invoice include?
Your name or business name and contact details, the parent or student who pays, a unique invoice number, the billing period, and one line per subject with the session dates, length and rate. Then any cancellation fee with the date and the policy it comes from, prepaid package sessions shown at the package rate with the prepayment subtracted, sales tax only if your state taxes tutoring, and the balance due with a date. The example above is a Bellevue tutor's October bill: $945.00 of sessions and fees, $480.00 of SAT sessions covered by a prepaid package, no sales tax, $465.00 due.
Line items tutors actually bill
- One line per subject, with every session date, the length and the rate: "Precalculus 1:1, 60 min, in person: Oct 1, 8, 15, 29", 4 × $90. Dates are what a parent checks against the calendar.
- In person or online on the line. It explains a different rate, and in Washington it matters for group classes, which are taxed where each student attends.
- Late cancellations and no-shows as separate lines, with the time the message came in and the policy percentage.
- Package sessions at the package rate, with the prepayment subtracted at the bottom and the sessions remaining in the notes.
- Work outside the session that you charge for: practice-test scoring, essay feedback, a progress report for the school.
- Who the student is. The person paying is often not the person tutored; put the student's name and grade next to the parent's.
How the example adds up
| Part of the month | Lines | Amount |
|---|---|---|
| Precalculus | 4 sessions × $90 | $360.00 |
| Late cancellation | Oct 22, 50% of $90 | $45.00 |
| SAT Math | 4 sessions × $120 (package rate) | $480.00 |
| Practice test review | 1 × $60 | $60.00 |
| Subtotal | No sales tax (one-on-one, Washington) | $945.00 |
| Prepaid package | 4 of 10 SAT sessions used | −$480.00 |
| Balance due | Nov 14, 2026 | $465.00 |
The package itself was billed once, on Sep 26: 10 sessions for $1,200 instead of 10 × $135 = $1,350. After October, 6 sessions ($720.00) are left on it.
Washington: one-on-one tutoring has no sales tax, group classes do
The 2025 law. ESSB 5814 made live presentations taxable from October 1, 2025. The Department of Revenue describes them as "lectures, seminars, workshops, or courses where participants attend either in person or via the Internet or telecommunications equipment that allows audience members and the presenter or instructor to give, receive, and discuss information with each other in real time", and its list of what is included has "In-person and online instructional classes, lessons, workshops, seminars, or other programs that are provided in real time." (DOR, Live presentations.)
The tutoring exclusion. The same page lists what live presentations do not include, among them "One-on-one instructional activities such as tutoring, consulting, or music lessons." The Department's interim guidance has a worked case: a $350 one-on-one CPR course is "not a retail sale of a live presentation because a live presentation requires the activity to allow more than one attendee." (Interim guidance statement on ESSB 5814 live presentations.) That is why the example has no tax line and Tax % is 0.
Where it flips. One of the Department's four considerations is "The activity must allow for more than one attendee." So a paid SAT class for four students is a live presentation, and you would add Washington sales tax. For online classes the guidance sources the sale to where each student is: "sales of remote live presentations are received at the physical location where each attendee (purchaser) is participating." Two students in one session is not addressed by name; by the more-than-one-attendee test it looks taxable, so ask DOR before invoicing it without tax.
The law is being challenged. The Department notes that it "is currently involved in ongoing legal proceedings regarding the classification of services newly subject to retail sales tax", and that "affected taxpayers must report, collect, and remit taxes in accordance with current guidance." (DOR, Services newly subject to retail sales tax.)
Washington B&O tax: yours, not the family's
Washington's service classification "includes persons rendering professional or personal services to persons (as distinguished from services rendered to personal property of persons)", and the rule's list of examples includes teachers (WAC 458-20-224). The rate for "Service & other activities (Less than $1,000,000 in the prior year)" is .015, i.e. 1.5% (DOR, B&O tax classifications), so $1,000 of tutoring income works out to $15.00 of B&O. "The B&O tax is not collected from customers." and "Because it is based on gross income, businesses cannot deduct expenses such as labor, materials, taxes, or other costs of doing business." (DOR, Business & occupation tax.) It does not go on the invoice.
Packages and cancellation fees
The example tutor's policy is 24 hours' notice, half the session for late notice and the full session for a no-show, written into an agreement the parents signed in September and quoted again in the notes. Those are her terms, not a legal rule. What makes the fee easy to accept is that the invoice points back to something the family already agreed to. For packages, bill the prepayment once, then show each session used on the monthly invoice and subtract it, so the family can see what is left.
1099s, Schedule C and what parents can deduct
1099s. The IRS: "Report on Form 1099-MISC or Form 1099-NEC only when payments are made in the course of your trade or business. Personal payments are not reportable." A business files a 1099-NEC for anyone it paid "at least $2,000 in: Services performed by someone who is not your employee (including parts and materials)" (Instructions for Forms 1099-MISC and 1099-NEC). The Okafors won't send one; a tutoring agency paying you as a contractor might.
Your income. "Use Schedule C (Form 1040) to report income or (loss) from a business you operated or a profession you practiced as a sole proprietor." (2025 Instructions for Schedule C.) "You usually must pay self-employment tax if you had net earnings from self-employment of $400 or more." (IRS Topic 554.)
For the parents. Publication 502 lets a family include "fees you pay on a doctor’s recommendation for a child’s tutoring by a teacher who is specially trained and qualified to work with children who have learning disabilities caused by mental or physical impairments, including nervous system disorders." (IRS Publication 502.) Regular homework help or SAT prep does not fit that description. For a health FSA, qualified medical expenses "are those specified in the plan that would generally qualify for the medical and dental expenses deduction" (IRS Publication 969), so the plan has the final word.
This is a summary of Washington Department of Revenue guidance, WAC 458-20-224 and IRS instructions and publications as of October 2026, not legal or tax advice. Other states tax tutoring differently; check your state's rules with an accountant.
FAQ
Is tutoring taxable in Washington state?
One-on-one tutoring: no sales tax. Since Oct. 1, 2025, ESSB 5814 makes "live presentations" retail sales, but the Department of Revenue's list of what live presentations do not include has "One-on-one instructional activities such as tutoring, consulting, or music lessons." Its interim guidance gives the reason: a one-on-one course is not a live presentation "because a live presentation requires the activity to allow more than one attendee." You still owe B&O tax on what you earn, and "The B&O tax is not collected from customers."
Is group tutoring or an SAT class taxable in Washington?
Very likely, yes. The Department lists "In-person and online instructional classes, lessons, workshops, seminars, or other programs that are provided in real time" as live presentations, and one of its tests is "The activity must allow for more than one attendee." A four-student SAT boot camp you sell to families meets that test, so you would collect retail sales tax. Sessions with two students (siblings, a study pair) are not addressed by name; by the Department's own test they allow more than one attendee, so ask DOR before you invoice them without tax. Classes run by a school as part of its accredited program are excluded.
Is tutoring subject to sales tax in other states?
We only verified Washington for this page. Washington's answer comes from how its 2025 law defines live presentations, so don't assume another state follows it. Look up your own state revenue department's guidance on educational or instructional services before you leave tax off.
How do I show a prepaid tutoring package on an invoice?
Bill the package once, when the family buys it (the example's package invoice was LT-2609-PKG: 10 SAT sessions for $1,200). Then, on each monthly invoice, list the package sessions you actually taught at the package rate and subtract them with a fixed Discount labelled with what was used: "Prepaid SAT package: 4 of 10 sessions used (LT-2609-PKG)", −$480.00. Put the sessions remaining in the notes. The family sees every session, and the balance only includes what the package doesn't cover.
How should a tutoring cancellation fee appear on the invoice?
As its own line, with the session it replaces, when the cancellation came in, and the rule it falls under: "Late cancellation, Precalculus Oct 22: cancelled at 1:15 pm for 4:30 pm, under 24 h notice (50% per policy)", $45. Quote the policy in the notes and say when it was agreed, so the parent can match the fee to something they signed. The 24 hours and the 50% are the example tutor's terms, not a legal rule; use whatever your own policy says.
Will parents send me a 1099 for tutoring?
Usually not. The IRS says: "Report on Form 1099-MISC or Form 1099-NEC only when payments are made in the course of your trade or business. Personal payments are not reportable." Parents paying for their own child's tutoring are making personal payments. A business that hires you (a tutoring company that pays you as a contractor, a school buying sessions) files a 1099-NEC if it paid you at least the threshold, which the IRS says increased to $2,000 for tax years beginning after 2025. You report the income either way.
Is tutoring income taxable? Do I pay self-employment tax?
Yes, it is income. If you tutor as a business, it goes on Schedule C: "An activity qualifies as a business if your primary purpose for engaging in the activity is for income or profit and you are involved in the activity with continuity and regularity." And from IRS Topic 554: "You usually must pay self-employment tax if you had net earnings from self-employment of $400 or more." Keep your invoices numbered and dated; they are your income record.
Can parents deduct tutoring or pay for it from an FSA or HSA?
Ordinary tutoring, no. IRS Publication 502 allows one case as a medical expense: "fees you pay on a doctor’s recommendation for a child’s tutoring by a teacher who is specially trained and qualified to work with children who have learning disabilities caused by mental or physical impairments, including nervous system disorders." For a health FSA, Publication 969 says qualified medical expenses "are those specified in the plan that would generally qualify for the medical and dental expenses deduction", so the plan decides. If a family asks for that kind of invoice, put the doctor's recommendation date and your specialist training on it, and let them check with their plan.
Should I invoice tutoring per session or monthly?
Monthly in arrears works for weekly students: one invoice, every session dated, fewer payment reminders. Per-session invoices suit one-off exam cram sessions or new families you haven't billed before. Packages are invoiced up front. Whichever you use, put the dates on the lines; "4 sessions" with no dates is what families question.
Is a tutoring receipt different from a tutoring invoice?
An invoice asks to be paid; a receipt records a payment you received. Parents asking for a receipt for their records, an employer benefit or a reimbursement need the same detail: dates, subject, rate and amount paid. From the same form, enter the payment in Discount ("Paid Nov 3 by Zelle") so the balance shows $0.00, and keep the invoice number so the two documents match.
